However, 1031 exchanges come with strict deadlines that must be carefully observed. Failing to meet these timelines can invalidate the exchange, resulting in unexpected tax consequences. Selling Your Relinquished Property

While the IRS doesn't dictate when you can sell your relinquished property, the timing of the sale significantly impacts the subsequent exchange deadlines. It's crucial to have a solid plan in place before listing your property to ensure a smooth and compliant 1031 exchange.

Engaging a Qualified Intermediary (QI) is paramount. The QI holds the proceeds from the sale of your relinquished property and facilitates the purchase of the replacement property, ensuring compliance with IRS regulations. Secure a QI at least a week before closing on the sale of your relinquished property.

Keep accurate records of the sale date and all related details, as this information will be required when filing Form 8824 (Like-Kind Exchanges) with your tax return.

45-Day Identification Period

Note that the 180-day deadline can be affected by your tax filing deadline. If the 180-day period extends beyond the due date of your tax return (typically April 15th), you must file for an extension to avoid penalties. Consult with a tax professional to determine the best course of action.

Extensions Due to Disaster Declarations

In certain circumstances, such as federally declared natural disasters or widespread epidemics, the IRS may grant extensions to the 1031 exchange deadlines. For example, extensions were granted during the Coronavirus Pandemic.
